Please read these Terms of Service ("Terms") carefully before using ClearStatement ("the Service"). By subscribing to or using the Service, you agree to be bound by these Terms.

1. About ClearStatement

ClearStatement is a software-as-a-service tool that assists UK mortgage brokers in categorising bank statement transactions using artificial intelligence. The Service is operated by David Titherington, trading as ClearStatement, based in the United Kingdom.

2. Eligibility

The Service is intended for use by authorised and regulated mortgage brokers and financial intermediaries operating in the United Kingdom. By subscribing, you confirm that you are acting in a business capacity and not as a consumer.

Upon subscribing, you will receive a unique licence key by email. This key is personal to you and must not be shared with third parties. ClearStatement reserves the right to revoke any licence key found to be in unauthorised use.

6. Data and Privacy

Bank statement data is processed entirely within your browser. Raw transaction data is transmitted to our AI categorisation service (Anthropic) over an encrypted connection solely for the purpose of categorisation. No client data is stored on ClearStatement's servers.

You remain responsible as the data controller for any personal data you process using the Service. By using the Service, you agree to our Privacy Policy and to ensure your use is compliant with UK GDPR and any applicable FCA requirements.

7. AI Categorisation

The AI categorisation feature is provided as a productivity aid only. ClearStatement does not guarantee the accuracy of any categorisation output. You are responsible for reviewing and verifying all categorised transactions before relying on them for any mortgage application or financial assessment.

8. Availability

ClearStatement aims to provide continuous availability of the Service but does not guarantee uninterrupted access. Scheduled maintenance or third-party outages (including Anthropic or Cloudflare) may occasionally affect availability. No refunds are provided for temporary outages.

9. Intellectual Property

All intellectual property rights in the Service, including its code, design, and content, are owned by or licensed to ClearStatement. You are granted a limited, non-transferable licence to use the Service for the duration of your subscription.

10. Limitation of Liability

To the fullest extent permitted by law, ClearStatement shall not be liable for any indirect, consequential, or incidental loss arising from your use of the Service, including but not limited to losses arising from inaccurate AI categorisation, data loss, or service interruption.

ClearStatement's total liability to you in any 12-month period shall not exceed the total subscription fees paid by you during that period.

11. Termination

You may cancel your subscription at any time via the customer portal. Access continues until the end of the current billing period. ClearStatement may suspend or terminate access if these Terms are breached.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

ClearStatement may update these Terms from time to time. You will be notified of material changes by email. Continued use of the Service after such notice constitutes acceptance of the updated Terms.
